Terms of service

1. About Aspen

Aspen Global Enterprise LLC ("Aspen", "we") is a car sharing platform that connects vehicle owners ("Owners" or "Hosts") with drivers ("Renters") looking to rent a vehicle. Aspen does not own any vehicles unless otherwise stated and is not a party to the rental agreement, which is made only between the Owner and the Renter. The rental agreement is a living agreement that runs from the listed start date and time to the end of the last extension, and is updated each time a rental extension or car swap is made.

2. Accounts

You must provide accurate information and keep your login secure. You are responsible for activity on your account. Aspen may suspend, close or reinstate accounts, ban Renters, and remove or review listings at its discretion, including for safety complaints, unpaid balances or violations of these Terms.

3. Renters

Renters must hold a valid, unexpired driver's license, pass a background check and license review, sign the rental agreement, and pay before a trip begins. Renters must use Aspen's platform insurance, placed with Knight Specialty Insurance Company, at $29 per day; third-party, personal or credit card coverage cannot replace it and the fee is never waived. A booking fee is charged on each rental. Luxury vehicles require a major credit card. Renters with an unpaid balance cannot book again until it is paid.

4. Owners

Owners must list vehicles they are authorized to rent, with a valid VIN, license plate and at least one photo, and keep them safe, clean and in good working condition. Every vehicle must be approved by Aspen before it can be booked. Owners set their own daily prices, mileage limits, delivery and out-of-state rules. Owners must take at least 20 interior and 20 exterior photos and record the odometer at pick-up, and 20 interior and 20 exterior photos at drop-off. Owners on the platform for a year or more must complete a maintenance check for each vehicle.

5. Payments and payouts

Renter payments are processed by PayPal. Aspen retains a platform fee from each Owner payout. Owner payouts are processed every Friday. Owners provide tax information (W-9) and receive a year-end Form 1099 where required.

6. Late returns, recovery and termination

Renters have a 12-hour grace period after the scheduled return time, after which a $20 late fee applies. At 24 hours late the Owner may recover the vehicle, and the Renter must surrender all keys; if the Renter refuses, the Owner may report the vehicle stolen. The Owner may terminate the agreement immediately if the vehicle is used for illegal activity.

7. Extensions and vehicle switches

The rental agreement is a living agreement. When a trip is extended, it updates automatically with the new return date and continues without a new signature. If the Owner switches the Renter to another vehicle, the Renter must sign the updated agreement.

8. Incidentals and damage

Owners may charge Renters for fuel, cleaning, smoking, tolls, tickets, damage and other costs incurred during a rental, supported by photos or documents. Renters and Owners may report each other to Aspen for review.

9. Disclaimers and limitation of liability

The platform is provided "as is". To the fullest extent permitted by law, Aspen is not liable for indirect, incidental or consequential damages arising from use of the platform or any vehicle, and Aspen's total liability is limited to the fees Aspen received from you in the 12 months before the claim.

10. Governing law and contact

These Terms are governed by the laws of the State of Georgia, and disputes will be resolved in the courts located in Georgia. We may update these Terms by posting a new version here. Questions: info@aspenglobalenterprisellc.com.

How we use it

To run the platform: verify renters, arrange and document trips, create and sign rental agreements, process payments and payouts, prepare tax forms, show nearby cars, send notifications, handle reports and disputes, prevent fraud, and meet legal obligations.

Who we share it with

Between Owners and Renters as needed for a trip (for example, the pick-up address after payment, and Owner contact details according to the Owner's privacy setting); with service providers such as PayPal for payments and our hosting and AI providers; with insurers and law enforcement when required or to protect people and property. We do not sell your personal information.

Security and retention

Sensitive records such as license photos, trip photos, bank and tax details are stored privately and shown only to the people who need them. We keep trip, payment and tax records as long as needed for insurance, tax and legal purposes, including after an account is closed.

1. Parties

This Rental Agreement ("Agreement") is made only between the Renter named above and the Owner named above (also called the "Host") who owns the Vehicle. Aspen Global Enterprise LLC ("Aspen") operates the car sharing platform through which this rental is arranged, does not own the Vehicle unless otherwise stated, and is not a party to this Agreement. References to Aspen in this Agreement describe platform services, fees and policies only.

2. Eligibility

Renter confirms they hold a valid, unexpired driver's license, have consented to a background check, and are legally permitted to drive in the state where the Vehicle is rented. Only the Renter may drive the Vehicle unless the Host approves an additional driver in writing.

3. Rental period and return

Renter will pick up and return the Vehicle on the dates above at the location agreed with the Host. Delivery and pickup of the Vehicle to another location are offered only at the Host's sole discretion, on terms (including any fee) agreed directly between Renter and Host; Aspen does not guarantee delivery. Renter has a 12-hour grace period after the scheduled return time. If the Vehicle is returned more than 12 hours late, a late fee of $20 is added to the amount Renter owes. If the Vehicle is 24 hours or more past the scheduled return time, the Host may recover (pick up) the Vehicle wherever it is located, and Renter authorizes this recovery. Upon recovery, Renter must immediately surrender all keys, key fobs and access devices for the Vehicle to the Host. If Renter fails or refuses to surrender the keys or the Vehicle, the Host may report the Vehicle as stolen to law enforcement.

4. Payment

Renter agrees to pay the rental total, an insurance fee of $29 for each rental day, and any incidental charges described in this Agreement.

5. Mileage

The Vehicle's mileage allowance is stated above. The odometer is recorded before the trip begins. Miles driven beyond the allowance may be charged to the Renter.

6. Condition, inspection and fuel

The Vehicle has been documented with interior and exterior photographs and an odometer reading before pickup. Renter must return the Vehicle in the same condition, less normal wear, and with the same fuel or charge level. Missing fuel, excessive cleaning, and smoking in the Vehicle may be charged.

OIL CHANGES AND ROUTINE MAINTENANCE: If the Vehicle needs an oil change during the rental (for example, a dashboard maintenance light or reminder appears, or the mileage interval is reached), Renter must notify the Host at Renter's earliest convenience so the Host can schedule the appointment. Renter must not arrange service on the Vehicle without the Host's approval.

7. Prohibited uses

Renter will not: drive under the influence of alcohol or drugs; use the Vehicle for any illegal purpose, racing, towing, or off-road driving; carry passengers or goods for hire, including rideshare or delivery apps; take the Vehicle outside the continental United States; smoke or vape in the Vehicle; or allow any unauthorized driver to operate it.

TERMINATION FOR ILLEGAL ACTIVITY: If Renter uses the Vehicle for, or engages in, any illegal activity during the rental, the Host may terminate this Agreement immediately, without prior notice. Upon termination, Renter's right to possess and use the Vehicle ends, Renter must stop using and return the Vehicle at once, and the Host may recover the Vehicle wherever it is located. Renter authorizes this recovery, forfeits any unused rental days without refund, and remains responsible for all fees, charges, damage, fines and recovery costs arising from the rental. The Host or Aspen may report the activity to law enforcement.

8. Damage, loss and incidentals

Any damage to the Vehicle that occurs during the rental period is Renter's fault and responsibility. Renter is responsible for damage to or loss of the Vehicle occurring during the rental period, to the extent permitted by law and subject to any applicable insurance coverage. Renter is also responsible for tolls, parking tickets, traffic citations, and related administrative fees incurred during the rental. These may be charged as incidentals after the Vehicle is returned, supported by photographs or documents.

9. Accidents and theft

Renter must report any accident, damage, theft, or mechanical problem to the Host immediately, and to law enforcement when required by law, and must cooperate with any insurance claim or investigation.

10. Insurance

Coverage for this rental is provided only through Aspen Global Enterprise LLC's platform insurance, placed with Knight Specialty Insurance Company. Renter may not decline the platform insurance or substitute third-party insurance, including Renter's personal auto policy, credit card rental coverage, or any separately purchased rental insurance, and the $29 daily insurance fee will not be waived or reduced for any such coverage. The $29 daily insurance fee is collected by Aspen Global Enterprise LLC toward the platform's insurance costs; coverage is limited to the terms of the policy in effect.

11. Limitation of liability and indemnity

To the fullest extent permitted by law, Renter agrees to indemnify and hold harmless the Host and Aspen from claims, losses, and expenses arising from Renter's use of the Vehicle, except those caused by the Host's or Aspen's gross negligence or willful misconduct.

12. Governing law

This Agreement is governed by the laws of the State of Georgia. Any dispute will be resolved in the courts located in Georgia.

13. Electronic signature

By typing their name and selecting "Sign contract", the Renter agrees that this is their legal electronic signature, that they have read and agree to this Agreement, and that it has the same effect as a handwritten signature. If the rental is extended, this Agreement is updated automatically with the new return date and continues to bind the Renter through the end of the last extension without a new signature; charges for the extra days apply at the same daily rate.
